Die Erhebung Ihrer Daten erfolgt
Umfang der Verarbeitung personenbezogener Daten
Wir erheben und verwenden personenbezogene Daten unserer Nutzer grundsätzlich nur, soweit dies zur Bereitstellung unserer Leistungen erforderlich ist. Die Erhebung und Verwendung personenbezogener Daten unserer Nutzer erfolgt regelmäßig nur nach Abschluss eines Vertrages oder nach Einholen einer Einwilligungserklärung. Eine Ausnahme gilt in solchen Fällen, in denen eine vorherige Einholung einer Einwilligung aus tatsächlichen Gründen nicht möglich ist und die Verarbeitung der Daten durch gesetzliche Vorschriften gestattet ist.
Rechtsgrundlage für die Verarbeitung personenbezogener Daten
Soweit wir für Verarbeitungsvorgänge personenbezogener Daten eine Einwilligung der betroffenen Person einholen, dient Art. 6 Abs. 1 lit. a EU-Datenschutzgrundverordnung (DSGVO) als Rechtsgrundlage. Bei der Verarbeitung von personenbezogenen Daten, die zur Erfüllung eines Vertrages, dessen Vertragspartei die betroffene Person ist, erforderlich ist, dient Art. 6 Abs. 1 lit. b DSGVO als Rechtsgrundlage. Dies gilt auch für Verarbeitungsvorgänge, die zur Durchführung vorvertraglicher Maßnahmen erforderlich sind. Ist die Verarbeitung zur Wahrung eines berechtigten Interesses unseres Unternehmens oder eines Dritten erforderlich und überwiegen die Interessen, Grundrechte und Grundfreiheiten des Betroffenen das erstgenannte Interesse nicht, so dient Art. 6 Abs. 1 lit. f DSGVO als Rechtsgrundlage für die Verarbeitung.
5. Kategorien der personenbezogenen Daten, die verarbeitet werden
Die HORSCH Gruppe verarbeitet folgende personenbezogene Daten von Ihnen:
6. Gemeinsame Verarbeitung
Die Gesellschaften der HORSCH Gruppe haben einen Vertrag nach Art. 26 DSGVO über die gemeinsame Verarbeitung von personenbezogenen Daten geschlossen.
Jede weitere, zur HORSCH Gruppe hinzukommende Gesellschaft ist verpflichtet, diesem Vertrag beizutreten, da andernfalls eine gemeinsame Datenverarbeitung nach Art. 26 DSGVO nicht erfolgen darf.
Die Gesellschaften der HORSCH Gruppe verarbeiten insbesondere personenbezogene Daten etwa von Kunden, Partner bzw. Händler, Angestellten oder Bewerber sowie Lieferanten etc. Die Gesellschaften der HORSCH Gruppe setzen dabei gemeinsame (Datenverarbeitungs-) Programme und Systeme ein, welche eine gemeinsame Verarbeitung von personenbezogenen Daten ermöglichen.
Die einzelnen Datenflüsse zwischen den Gesellschaften untereinander sowie die Zwecke der gemeinsamen Datenverarbeitung sind detailliert in dem zwischen den Gesellschaften geschlossenen Vertrag geregelt. Die wesentlichen vertraglichen Regelungen können bei Bedarf wörtlich eingesehen werden. Eine entsprechende Anfrage ist beim Datenschutzbeauftragten der einzelnen Gesellschaften oder bei jeder einzelnen Gesellschaft der HORSCH Gruppe zu stellen.
Jede Gesellschaft der HORSCH Gruppe ist bzgl. der durch sie originär erhobenen personenbezogenen Daten selbst für die Gewährleistung der Betroffenenrechte nach den Art. 12 ff. DSGVO verantwortlich. Jede Gesellschaft der HORSCH Gruppe informiert daher die von ihrer Datenverarbeitung Betroffenen selbst nach Maßgabe der Art. 13 und 14 DSGVO und stellt den Betroffenen einen Ansprechpartner für die Geltendmachung der Betroffenenrechte zur Verfügung. Jeder von der Datenverarbeitung Betroffene kann daher seine Rechte aus der DSGVO bei und gegenüber jeder einzelnen der Gesellschaften der HORSCH Gruppe geltend machen.
7. Dauer der Speicherung der personenbezogenen Daten
Die personenbezogenen Daten der betroffenen Person werden gelöscht oder gesperrt, sobald der Zweck der Speicherung entfällt. Eine Speicherung kann darüber hinaus erfolgen, wenn dies durch den europäischen oder nationalen Gesetzgeber in unionsrechtlichen Verordnungen, Gesetzen oder sonstigen Vorschriften, denen der Verantwortliche unterliegt, vorgesehen wurde. Eine Sperrung oder Löschung der Daten erfolgt auch dann, wenn eine durch die genannten Normen vorgeschriebene Speicherfrist abläuft, es sei denn, dass eine Erforderlichkeit zur weiteren Speicherung der Daten für einen Vertragsabschluss oder eine Vertragserfüllung besteht.

Werden Ihre personenbezogenen Daten verarbeitet, so haben Sie das Recht Auskunft über die zu Ihrer Person gespeicherten Daten zu erhalten (Art. 15 DS-GVO).
Sollten unrichtige personenbezogene Daten verarbeitet werden, steht Ihnen ein Recht auf Berichtigung zu (Art. 16 DS-GVO).

Your data will be collected
Extent of processing of personal data
We collect and use the personal data of our users strictly only insofar as this is necessary for us to provide our services. Our users’ personal data as a matter of course, be collected only after the conclusion of a contract or after obtaining a declaration of consent. An exception shall apply in such cases where circumstances mean it is not possible to obtain prior consent and where the processing of the data is permitted by statutory provisions.
Legal basis for the processing of personal data
Insofar as we obtain the consent of the data subject for the processing of their personal data, Article 6 (1) (a) of the EU General Data Protection Regulation (GDPR) shall serve as the legal basis. Article 6 (1) (b) of the GDPR shall serve as the legal basis for the processing of personal data required to fulfil a contract to which the data subject is party. This shall also apply to processing operations necessary prior to entering into a contract. If data processing is necessary for the purpose of a legitimate interest of our company or that of a third party and if the interests, fundamental rights and freedoms of the data subject shall not outweigh the first interest, Article 6 (1) (f) GDPR shall serve as the legal basis for the processing.

The companies within the HORSCH Group have concluded a contract pursuant to Article 26 GDPR for the joint processing of personal data.
Every other company that shall join the HORSCH Group shall be obliged to enter into this contract, otherwise joint data processing under Art. 26 GDPR is not permitted to take place.
In particular, the companies within the HORSCH Group shall process personal data from customers, partners or dealers, employees or candidates, as well as suppliers, etc. The companies of the HORSCH Group shall use common (data processing) programs and systems, which shall enable joint processing of personal data.
Individual data flows between the companies, as well as the purposes for joint data processing, shall be regulated in detail in the contract concluded between the companies. The essential contractual regulations are available for viewing as required. Such a request must be made to the data protection officer of the individual companies or to each individual company of the HORSCH Group.
Each company within the HORSCH Group shall be responsible for guaranteeing the rights of data subjects in accordance with Article 12 ff. GDPR with regard to the personal data originally collected. Each company of the HORSCH Group hereby informs those affected by their data processing pursuant to Articles 13 and 14 GDPR and provides those data subjects with a contact person in order to exercise their rights. Data subjects may thus exercise their rights under GDPR with and against each individual company in the HORSCH Group.
7. Duration of retention of personal data
A data subject’s personal data shall be erased or locked as soon as the purpose of retention no longer applies. Information may also be retained if this has been provided for by the European or national legislator under EU regulations, laws or other provisions to which the controller is subject. The data will also be locked or deleted if the retention period prescribed by the standards mentioned expires, unless there is a need for further retention of the data for the conclusion or fulfilment of a contract.

Portée du traitement des données à caractère personnel

Base juridique pour le traitement des données à caractère personnel
Dans la mesure où nous demandons le consentement de la personne concernée pour les opérations de traitement des données à caractère personnel, l'article 6, paragraphe 1, point a), du règlement général sur la protection des données (RGPD) de l'UE sert de base juridique. En cas de traitement de données à caractère personnel nécessaire à l'exécution d'un contrat dont une partie contractuelle est la personne concernée, l'article 6, paragraphe 1, point b), du RGPD sert de base juridique. 6. Traitement commun
Les sociétés du groupe HORSCH ont conclu un contrat conformément à l'article 26 du RGPD sur le traitement commun des données personnelles.
Toute autre société rejoignant le Groupe HORSCH est tenue d'adhérer à ce contrat, faute de quoi le traitement commun des données ne peut avoir lieu conformément à l'article 26 du RGPD.
Les sociétés du Groupe HORSCH traitent en particulier les données personnelles de clients, partenaires ou concessionnaires, employés ou candidats, fournisseurs, etc. Les sociétés du groupe HORSCH utilisent à cet effet des programmes et systèmes communs (de traitement des données) qui permettent un traitement commun des données personnelles.
Les différents flux de données entre les sociétés ainsi que les finalités du traitement commun des données sont réglés en détail dans le contrat conclu entre les sociétés. Les principales dispositions contractuelles peuvent être consultées textuellement si nécessaire. Une demande correspondante doit être adressée au responsable de la protection des données de chaque société ou à chaque société du groupe HORSCH.
Chaque société du Groupe HORSCH est responsable individuellement de la garantie des droits des personnes concernées selon les articles 12 et suivants du RGPD en ce qui concerne les données personnelles qu'elle a elle-même collectées. Chaque société du groupe HORSCH informe donc elle-même les personnes concernées par son traitement de données conformément aux articles 13 et 14 du RGPD et met à la disposition des personnes concernées un interlocuteur pour faire valoir leurs droits. Toute personne concernée par le traitement des données peut donc faire valoir ses droits découlant du RGPD auprès et vis-à-vis de chacune des sociétés du groupe HORSCH.
7. Durée de conservation des données personnelles
Les données à caractère personnel de la personne concernée sont effacées ou bloquées dès que la finalité du stockage n'est plus applicable. Un stockage peut en outre avoir lieu si le législateur européen ou national l'a prévu dans des règlements, lois ou autres dispositions du droit de l'Union auxquels le responsable est soumis. Les données sont également bloquées ou supprimées lorsqu'un délai de stockage prescrit par les normes mentionnées expire, à moins qu'il ne soit nécessaire de continuer à stocker les données pour la conclusion ou l'exécution d'un contrat.

Zakres przetwarzania danych osobowych
Zasadniczo zbieramy i wykorzystujemy dane naszych użytkowników wyłącznie, jeśli jest to wymagane do udostępnienia naszych usług. Zbieranie i wykorzystywanie danych osobowych naszych użytkowników odbywa się z zasady tylko po zawarciu umowy lub po otrzymaniu oświadczenia o wyrażeniu zgody. Wyjątkiem są sytuacje, w których wcześniejsze uzyskanie oświadczenia o wyrażeniu zgody nie jest możliwe z przyczyn faktycznych, a przetwarzanie danych jest dozwolone przez przepisy prawne.
Podstawa prawna przetwarzania danych osobowych
Jeśli uzyskamy zgodę osoby, której dane dotyczą, na operacje przetwarzania danych, podstawą prawną jest art. 6 ust. 1 lit. a ogólnego rozporządzenia o ochronie danych (RODO). W przypadku przetwarzania danych osobowych, które są wymagane do realizacji umowy, której stroną jest osoba, której dotyczą dane, podstawą prawną jest art. 6 ust. 1 lit. b RODO. Spółki grupy HORSCH zawarły umowę zgodnie z art. 26 RODO, dotyczącą wspólnego przetwarzania danych osobowych.
Każda kolejna spółka dołączająca do grupy HORSCH jest zobowiązana do przystąpienia do tej umowy, w przeciwnym razie wspólne przetwarzanie danych wg art. 26 RODO nie może być realizowane.
Spółki grupy HORSCH przetwarzają w szczególności dane osobowe klientów, partnerów lub dystrybutorów, pracowników lub kandydatów, a także dostawców itp. Spółki grupy HORSCH stosują przy tym wspólne programy (do przetwarzania danych) oraz systemy, które umożliwiają wspólne przetwarzanie danych osobowych.
Poszczególne przepływy danych pomiędzy spółkami, a także cele wspólnego przetwarzania danych są szczegółowo uregulowane w umowie zawartej przez spółki. W razie potrzeby możliwe jest zapoznanie się z dosłownym brzmieniem istotnych regulacji umownych. Odpowiednie zapytanie należy złożyć u inspektora ochrony danych poszczególnych spółek lub w każdej spółce grupy HORSCH.
Zgodnie z art. 12 nn. RODO każda spółka grupy HORSCH jest samodzielnie odpowiedzialna za zabezpieczenie praw osób, których dotyczą dane, w odniesieniu do pierwotnie pobranych przez siebie danych osobowych. Dlatego zgodnie z art. 13 i 14 RODO każda spółka grupy HORSCH samodzielnie udziela informacji osobie, której dotyczą dane, a także udostępnia osobę kontaktową do dochodzenia praw osób, których dotyczą dane. Każda osoba, której dotyczą przetwarzane dane, może dochodzić swoich praw wynikających z RODO wobec każdej pojedynczej spółki grupy HORSCH.
7. Okres przechowywania danych osobowych
Dane osobowe osoby, której dane dotyczą, są usuwane lub blokowane, gdy cel ich zapisywania nie ma już zastosowania. Zapisywanie danych może mieć także miejsce, gdy zostało to przewidziane przez europejskiego lub krajowego ustawodawcę w rozporządzeniach prawa unijnego, ustawach lub innych przepisach, którym podlega administrator. Blokada lub usunięcie danych osobowych ma miejsce także, gdy upłynie jeden z przewidzianych przez wymienione normy terminów przechowywania danych osobowych, chyba że istnieje konieczność dalszego przechowywania tych danych w celu zawarcia lub realizacji umowy.
8. Prawa osoby, której dotyczą dane
Zgodnie z ogólnym rozporządzeniem o ochronie danych osobowych przysługują Państwu następujące prawa:
Jeśli przetwarzane są Państwa dane osobowe, mają Państwo prawo do informacji o zapisanych danych dotyczących Państwa osoby (art. 15 RODO).
Jeśli przetwarzane są nieprawidłowe dane osobowe, przysługuje Państwu prawo do ich sprostowania (art. 16 RODO).
Jeśli zachodzą warunki prawne, mogą Państwo domagać się usunięcia lub ograniczenia przetwarzania danych osobowych, a także wnieść sprzeciw wobec przetwarzania danych (art. 17, 18 i 21 RODO).
Jeśli chcą Państwo skorzystać z wymienionych wyżej praw, spółki grupy HORSCH sprawdzają, czy spełnione są ku temu warunki prawne.
W celu wykonania swoich praw prosimy zwracać się do zakładowego inspektora ochrony danych.
W przypadku skarg związanych z ochroną danych osobowych mogą Państwo zwrócić się do właściwego organu nadzorczego:
